Grandparents' Rights Visitation rights for grandparents is a complicated area of the law, and the law varies from state to state. It used to be that grandparents had a right to an ongoing relationship with their grandchildren if the grandchildren's parents divorced, but that changed with a June, 2000 Supreme Court decision that essentially said that parents have the right to determine whether or not grandparent visitation would occur. Since that time, states have been writing new laws. Some have withstood court rulings and others have not. At this time, there is not a definitive answer about grandparents' rights and visitation.
