Are You Being Sued for Credit Card Debt?

In rough economic times, people often rely on their credit cards to get them through, reasoning that when things improve financially, they will be able to pay off the debt.  The trouble is that unless you can make more than the minimum payments on your credit card debt, it will take years to pay them off.   If you stop making payments all together, it is quite possible that your credit card company will sue you for the full amount due.

If your credit card company decides to sue you, you will receive a summons and will have to appear in court.  You cannot go to prison for non-payment of credit card debt, and the worst that will happen is you will be ordered by the court to pay the credit card company the money you owe them.  The judge will set the terms of the re-payment schedule.

It is best not to let things get to this point for several reasons.  One, if you miss your court date, a bench warrant may be issued for your arrest.  Two, if you lose your court case, you are now under a court order, and violation of it can lead to further punishment.  Third, you are now not only responsible for re-payment of the credit card debt but also for court costs.

There are defenses to being sued for credit card debt.   First, file for an extension of time to delay the court hearing.   A motion to dismiss may be filed if the credit card company (bank) does not follow proper procedures in filing the lawsuit against you.   This alone may be enough to get the credit card company to discuss a settlement and avoid a court hearing.

If you are being sued by a credit card company, contact us.  We can put you in touch with an affordable, local contract lawyer in your state.  Our rates are very reasonable, you should not go up against a credit card company alone.   We've helped thousands of people get the legal assistance they need, and we can help you, too.
